TAPA Enrolment Application

Conditions of Enrolment
Welcome to the Townsville Academy of Performing Arts (TAPA). To enrol your child at TAPA, please complete the form below or you may collect and complete a paper form from the Academy during normal business hours.

As a new enrolment, by submitting this form there is no guarantee that your child will secure a place at TAPA, with preference given to re-enrolling students. If your child is unsuccessful in securing a place, their name shall be placed on a waiting list and as a vacancy becomes available you shall be notified if you wish to accept it.

An annual administration/copyright fee must be paid upon enrolment confirmation. This fee needs to be paid annually and no student shall be permitted to participate in a class until it has been paid.

	Terms & Conditions TERMS AND CONDITIONS Copyright TAPA - All Rights Reserved 1. I, , am the parent or legal guardian of the abovenamed child, . 2. I consent to the abovenamed child, to which I am the parent or legal guardian, participating in classes conducted by the Townsville Academy of Performing Arts (TAPA). 3. I understand that, if the above named child suffers any injury, loss or damage as a result of participation in classes or events conducted at TAPA or other activities that he/she participates in as a representative of or in any way associated with TAPA, I am bound by clauses 12, 13, 14 and 20 of these terms and conditions. I also understand that, when the above named child reaches the age of eighteen (18) years, he/she will be bound by these terms and conditions. SCHEDULED FEES 4. I undertake to diligently pay all fees owed to TAPA as a result of the participation of my child in classes and other events and activities that my child participates in as a representative of or in any way associated with TAPA. 5. I understand that term fees are due at the commencement of each term, where each term is defined as being of the identical duration and days decreed by Education Queensland. 6. All invoices issued by TAPA are a 14 day account. In the event that I have not paid outstanding fees by the due date and not sought special consideration from TAPA, I understand that the recovery of this debt may be placed with a registered debt collection agency, where legal action may be instigated. Should the matter be handed to the said agency I agree to pay all debt collection charges as established between the Academy and its solicitor/Commercial Agent. Payments to my account shall be credited in order to debts of longest to least duration. 7. I understand that I shall be given a 10% fees reduction by TAPA, if the FULL term fees are paid within the first two (2) weeks of the term commencing. I must pay these fees prior to the issuing of invoices to ensure that I receive this discount. 8. I understand that I shall be given a further 10% fees reduction by TAPA, if my child or children attend five (5) or more classes per week. TAPA reserves the right to rescind this discount in the event of the late payment of fees. 9. No allowance against fees or make up lessons can be made for late returns to class or absence during the term. ENROLMENT 10. I acknowledge that enrolment throughout the year is automatic and if my child will not be attending the following term’s classes, TAPA must be advised, failing which full-term fees will be charged. 11. If I have not sought special consideration, I understand that my child’s enrolment will be cancelled at the end of term if fees for that and any previous terms remain unpaid. Upon cancellation, my child’s secured place will be offered to an eligible child on the TAPA waiting list. ACKNOWLEDGEMENT OF RISKS AND VOLUNTARY ASSUMPTION OF LIABILITY 12. I understand and acknowledge and accept that participation in classes or events at TAPA and other activities that my child participates in as a representative of or in any way associated with TAPA inherently involves risk to the abovenamed child’s personal safety. 13. I hereby accept that, if the abovenamed child is injured while participating in classes or events at TAPA or other activities that my child participates in as a representative of or in anyway associated with TAPA, he/she is entirely responsible for any injuries that he/she may suffer and for any loss or damage that may occur as a result of those injuries. 14. I hereby release and discharge, both on my own behalf and on behalf of the above named child, TAPA, its representatives, agents or employees, from any claims of any nature whatsoever that I or the above named child now have or may in the future have against TAPA, its representatives, agents or employees, whether arising as a result of negligence of any nature whatsoever on the part of TAPA, its representatives, agents or employees or otherwise arising at common law or under any statute, in any way whatsoever. This means that I and the above named child are precluded from making a claim either in tort or contract against Townsville Academy of Performing Arts (ABN 35 629 794 395), its representatives, agents or any employees for any injury, loss or damage that the above named child may suffer while participating in classes or events at TAPA or other activities that my child participates in as a representative of or in any way associated with TAPA. Further, I agree to indemnify and at all times hereafter to keep indemnified TAPA, its representatives, agents or employees in respect of all claims of any nature whatsoever made by me or the above named child and in respect of all costs, charges and expenses that may be incurred by TAPA, its representatives, agents or employees in defending or settling any such claim. 15. Notwithstanding the exclusions contained in this agreement, I understand and agree and accept that nothing in this agreement purports to exclude liability that may be owed by TAPA, its agents, representatives or employees pursuant to the Trade Practices Act 1974 or the Fair Trading Act 1989 in the State of Queensland. To the extent that any part of this agreement may contravene the Trade Practices Act 1974 or the Fair Trading Act 1989, I agree that part of the agreement may be severed and rendered void but that the rest of the agreement will remain valid and continue to have effect. A reference to an Act of Parliament or to any section thereof shall be deemed to have added words “or any statutory modifications or other enactment thereof or any statutory provisions substituted therefore” following such reference. RIGHT TO REJECT 16. I acknowledge that TAPA reserves the right to remove the above named child or parent or legal guardian from the premises and further tuition in the event of continued behaviour contrary to what is considered acceptable by TAPA, its representatives, agents or employees. Respect for other children, parents, TAPA representatives, agents or employees, and all property, either personal, belonging to TAPA or other is expected at all times. MEMBER'S PROPERTY 17. By accepting this agreement, I acknowledge and understand that any property of any nature whatsoever that the above named child brings onto the premises is there entirely at my and/or his/her own risk. 18. I acknowledge and understand and accept that I have no right of action against TAPA, its representatives, agents or employees of any nature whatsoever should the abovenamed child’s property be lost, damaged or stolen. PARENT OR LEGAL GUARDIAN RESPONSIBILITY 19. I hereby acknowledge that I shall provide the above named child with the required attire including, but not limited to dancewear, footwear or other equipment as required by TAPA to enable the above named child to participate fully in the class/es that the above named child is enrolled in. 20. (a) The full details including but not limited to name, residential address and contact telephone number of all representatives authorised to present and collect the above named child on my behalf from TAPA premises, events or other activities associated with TAPA shall be provided in writing to TAPA prior to such activity occurring. (b) I hereby acknowledge that I or an authorised representative shall endeavour to not present the above named child at a time no earlier than ten (10) minutes prior to the designated time of commencement of the class that the above named child is enrolled in, unless either prior notice is provided to an authorised TAPA representative or an emergent situation of an infrequent nature arises that precludes me from providing such notice. (c) I further acknowledge that I or an authorised representative shall endeavour to collect the above named child at a time no later than ten (10) minutes after the designated completion time of the class that the above named child is enrolled in, unless either prior notice is provided to an authorised TAPA representative or an emergent situation of an infrequent nature arises that precludes me from providing such notice. MEDICAL FITNESS 21. I hereby acknowledge that I have provided TAPA with a full and frank disclosure of any and all conditions which may affect the above named child’s ability to participate in classes at TAPA or other activities that my child participates in as a representative of or in any way associated with TAPA and agree that, if he/she participates in these classes, events or activities, notwithstanding his/her condition, I am bound by the acknowledgements contained in clauses 12, 13, 14 and 22 of this agreement. USE OF AMBULANCE 22. In the event that the above named child suffers an injury while he/she is on the business' premises, I hereby authorise TAPA, its representatives, agents or employees to call an ambulance on my and/or his/her behalf. I agree to indemnify TAPA for any and all costs incurred by TAPA in calling an ambulance on behalf of the above named child. If an ambulance is required, TAPA will take all reasonable courses of action to notify the parent/guardian and in their absence shall then notify one or both of the listed emergency contacts. ADVERTISING AND PROMOTIONAL MATERIAL 23. I consent to the above named child’s name and/or picture being used in the advertising and/or promotion of materials for TAPA and such use shall solely be for this purpose.
